By purchasing our services you are agreeing to the following terms.

We know most people are pretty cool, but to ensure quality service and performance for our customers and to maintain the integrity of our infrastructure, we need to include these terms of service.

The following Terms and Conditions govern all use of the hostify.com.au website and all content, services and products available at or through the website. Use of Hostify services constitutes acceptance and agreement to the Terms and Conditions below.

All content, services and products available via this website and through any other means are owned and operated by Jeesh Pty Ltd (ACN 157 860 298) trading as ‘Hostify’.

All transactions made with Hostify via this website and through any other means are in Australian Dollars (AUD).

Account Activation

By activating your account with Hostify, you agree to these Terms and Conditions. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

If you signup for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by email or phone prior to taking any action to provide you with an opportunity to correct the problem.

By signing up with us, you agree to these Terms and Conditions.

SERVICE AVAILABILITY

Hostify shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Hostify’s servers going offline or being unavailable for any reason whatsoever. Furthermore, Hostify shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Hostify’s servers. All damages shall be limited to the immediate termination of service.

SIMPLY

We have a great setup, but sometimes things happen. We do not guarantee your services will always be up. But we will do our best to keep them up and inform you if anything happens.

LIABILITY AND INDEMNITY

You agree to indemnify and hold harmless Hostify, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of Hostify services, including but not limited to your violation of this Agreement.

SIMPLY

If you use our service for anything dodgy, we will not go down with you.

PAYMENTS AND BILLING

On the account creation date and on that day each month following, Hostify will debit or charge your nominated account/credit card for the amount agreed to during the signup/sales process.

Hostify uses the EWay payment gateway for all payment processing.

All transmission of payment information takes place within an encrypted SSL tunnel.

If you choose to cancel your account, please note that we do not refund partial months. As of the day you cancel we will schedule the cancellation to take place on the following payment anniversary.

SIMPLY

You agree to pay us up front for each month’s services via direct debit or credit card. If you cancel, we will stop billing you going forward.

LATE PAYMENTS

It is the client’s responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send an email notification, at which point we will need to be provided with another account number or credit card. You will then be given a ten (10) day grace period. If payment is not made within the ten (10) day grace period, Hostify reserves the right to suspend your Service(s) with Hostify and to charge a $10 “late payment fee”. Thirty (30) days following suspension of Services for non-payment, Hostify reserves the right to terminate Service(s) for non-payment.

Hostify is not responsible for any damages or losses as a result of suspension or termination for non-payment of your account. In addition, Hostify reserves the right to refuse to re-activate your Services until any and all outstanding invoice(s) have been paid in full.

SIMPLY

If you don’t pay on time, we will give you some grace… Then switch your site off.

DELIVERY

All relevant details for your new hosting, domain name and back-end access are emailed to the address you registered with. You will receive these emails immediately once your plan has been paid for. You can also find your login details in your Hostify client area.

If you never receive your welcome email, please check your spam and junk folders. This is the most common complaint and in 99.9% of cases, the missing emails are located in your junk/spam folder. If it is not there, make sure to whitelist @hostify.com.au before requesting it again. If you need your welcome email resent, please submit a support ticket or contact us. You can also view all emails we send to you from your client area.

SIMPLY

We send all relevant account and product details out for your website via email. You can also get to them via the client portal or by emailing us.

CANCELLATIONS AND REFUNDS

Hostify reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice. Any abuse of our staff in any medium or format will result in the suspension or termination of your services.

Customers may cancel at any time. Hostify gives you an unconditional 30 day money back guarantee on all hosting plans. Cancellations requested after the initial 30 days will go into effect within 24hrs of the request. The monthly hosting fee for that month will not be refunded.

For design work, a refund may be requested if a project has not initiated or if the initial design style is not approved.

If we fail to deliver as per our delivery policy after the initial design style is approved, then we will issue a partial refund as per the proportion of the work completed.

If we have completed the project, you have agreed to it and it has been and uploaded onto the server, no refunds will be issued.

There are no refunds for domain name purchases.

SIMPLY

You can request a cancellation at any time and we will stop your service within 24hrs.

Refund amounts:

  • For Hosting: We will refund your monthly hosting fee if you cancel within the first 30 days as part of our guarantee. ANy cancellations after that and we will not refund that month’s hosting fee, but you will not be charged any further hosting fees.
  • For Design: If it hasn’t started or it’s still in progress we will issue a full or partial refund relevant to the work percentage completed.
  • For Domain names: No refunds.

ACCEPTABLE USE

All services provided by Hostify may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Australian Federal, State or Local law is prohibited. We reserve the right to refuse sites promoting things that violate the laws of other countries as well.

Note: Pornography and sex related merchandising are prohibited on any Hostify servers. This includes sites that may imply sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to Hostify servers or any other server on the Internet. Links to such materials are also prohibited.

Examples of prohibited content or links include (but are not limited to): Pirated software, hacking programs or archives, Warez sites, distribution of music files or any other material in which the account holder does not own the copyright, porn spamming software, adult sites and game servers. Hostify will be the sole arbiter as to what constitutes a violation of this provision. Content that does not meet these standards will be removed without prior notice to the customer.

SIMPLY

Nothing weird, creepy or illegal, or we will switch your site off.
